HyperVerge Private Technologies Limited ( referred to as “HyperVerge”, “We”, “Our”, or “Us”), is committed to respect and protect the privacy of the users (“You” or “Your”). This Privacy Policy (“Policy”) explains how We process and treat Your Personal Data (defined below) to enable Us to render services (“Services”) to the Partner Platform  (as defined herein). Partner Platform shall refer to the professional social media platform and its affiliates of which you are a member and from where You have been redirected.

Personal Data” means any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person.

YOUR CONSENT

By submitting your Personal Data in furtherance of the Services, You acknowledge that You accept and consent to this Privacy Policy including the collection, storage, sharing and usage of Personal Data. You further agree that We may retain any such documents or references evidencing Your consent (including DigiLocker/transaction  IDs) and reports and are authorized to share the same with Partner Platform. Notwithstanding anything to the contrary, You agree that Hyperverge and Partner Platform are hereby granted the right to use Personal Data submitted hereunder to train its internal services, AI and algorithms through machine learning techniques. 

Furthermore, on the basis of consent received from You or if required by applicable law, Hyperverge and Partner Platform may disclose certain categories of Personal Data indicated in the table provided above, to third-parties pursuant to the Services.

If You do not accept the terms of this Policy and/or not of legal age (i.e., if under 18 years or below), not please do not submit Your Personal Data or proceed further. PERSONAL DATA THAT WE COLLECT

We value the privacy of your Personal Data. The types of Personal Data that we may receive, collect, store and process fall into the following categories:

• Information that You provide to Us voluntarily

In furtherance of the Services We collect Personal Data submitted by the data subject, solely for the purpose of identity verification namely for the checks of Liveness, Face-match, ID verification    to be conducted with respect to the relevant data subject.  

We do not collect any information about Your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about Your health, genetic, or any information about criminal convictions and offences.

•  Information that We collect automatically

When You visit the website or by proceeding further, certain information from Your device using cookies and similar tracking technology is automatically collected.  

Specifically, the information We collect automatically includes information like Your IP address, device type, broad geographic location (e.g., country or city-level location), and other technical information including keeping track of the sites and links that have been visited and clicked on by Your device. 

We use this information for Our internal analytics purposes and to improve the quality and relevance of the Services.

•  Information that We obtain from third party sources

From time to time, We may receive Personal Data about You from third party sources, but only after ensuring that these third parties have either obtained Your consent or are otherwise legally permitted or required to disclose Your Personal Data to Us.

 

NON PERSONAL INFORMATION THAT WE COLLECT 

Non-Personal Information is the information that does not identify You by name or as an individual person. It includes information like:

Usage data: We collect non-personal usage data about You whenever You interact with Us. We may directly collect analytics data, or use third-party analytics tools, to help Us measure traffic and usage trends for the Service. The sites you see and other data you access, that helps Us improve the Service are collected by these tools from Your browser or mobile device. We gather and use this analytics information in an aggregate form, making it impossible to manipulate or deduce for the purpose of identification of any specific individual User.

We use Non-Personal Information in an ongoing effort to better understand and serve Our Users and to improve the content and functionality of the Service. We also conduct research on Our User demographics and behaviour based on Personal Data and the Non-Personal Information that We have collected. This research is compiled and analysed on an aggregate basis and this aggregate does not identify You and therefore is considered and treated as Non-Personal Information under this Policy. However, if this aggregated data can directly or indirectly identify You, We treat the combined data as Personal Data which is used in accordance with this Policy.

We track non-personal information about traffic and Users of the Services, using third-party tools that utilize cookies; to create statistics summaries of the activities on the Services as well as to benchmark the Service.

 

HOW DOES HYPERVERGE USE THE INFORMATION WE COLLECT?

  • To help enforce our terms and conditions in this Policy and agreements with  Partner Platform. 
  • Prevent potentially illegal activities such as cyber-crimes or fraudulent activities, pursuant to the applicable laws 
  • Meeting legal and regulatory requirements. For example, if We receive a subpoena or other legal request, We may need to inspect the data We hold to determine how to respond.
  • Understanding and analysing Our users’ needs and preferences and sending information that HyperVerge believes a User may find helpful and.

 

We rely on the following legal bases for processing Your Personal Data:  

  • Legitimate interest. This refers to the interest in conducting and managing Our business to enable Us to provide the Services and the most secure experience possible. We ensure to consider and balance any potential impact on You (both positive and negative) and Your rights before We process Your Personal Data for Our legitimate interests.   • To comply with a legal obligation. This means processing Your Personal Data if it is necessary to fulfill a legal obligation imposed on Us.

Unless it is reasonably ascertained that We need to use it for another reason which is compatible with the original purpose. DISCLOSURE OF YOUR PERSONAL DATA 

Unless otherwise disclosed in this Policy, We will only share your personal information we collect about You with Our authorised partners such as Partner Platform and authorised service providers, in connection with the Services. Partner Platform may, at its own discretion, share or use Personal Data with Partner Platform’s third parties or service provider as required and in line with their privacy policy, which privacy policy shall govern the further processing/storage/usage and transfer terms with respect to the Personal Data (We urge you to examine and assess the said privacy policy.) 

In certain extraordinary situations, We may also share your personal information investigating authorities, regulators, courts or government authorities where required by law to comply with a court order, direction, notification or request in accordance with the applicable laws as amended from time to time.  

In the event of a substantial transfer of assets or acquisition of HyperVerge, We would transfer your Personal Data to our buyers. 

 

LOG FILES

We follow a standard procedure of using log files. The website and applications use logs to see how many people visit them and what they do on the website. This information includes the person’s IP address, what browser they were using, what ISP they were using, and when the visit occurred. These are not linked to any information that can identify an individual and therefore is treated as Non Personal Information under this Policy. 

 

COOKIES 

Cookies are small bits of data we store on the device you use to access the Services. For security reasons, we use cookies to authenticate your identity, such as confirming whether you are currently logged in. HyperVerge is committed to delivering the best practices in the data privacy domain for You. We collect information under the direction of Partner Platform, and have no direct relationship with the individuals whose Personal Data it processes. In the situation You would like to access, rectify, erase, restrict or object to processing, or exporting Your Personal Data, We will extend Our sincere support in responding to Your request within a reasonable timeframe. 

We will retain this Personal Data as necessary to comply with Our legal obligations, resolve disputes, and enforce Our agreements which shall at all times be in compliance with the prevailing laws.

 

YOUR LEGAL RIGHTS  

Subject to the data protection laws that apply to You, You may have the following rights under various data protection legislation. In case of a dispute with respect to which jurisdiction is applicable to You, Indian laws and regulations shall apply.

DATA INTEGRITY AND SECURITY 

Hyperverge strives to maintain reasonable and appropriate security measures to ensure the accuracy and integrity of Personal Data. We have implemented physical and technical safeguards to protect Personal Data from loss, misuse, and unauthorized access, disclosure, alternation, or destruction. For Your further comfort, it is pertinent to note that We are ISO 27001 certified and also have a SOC2 Type 1 certification with respect to Our information security practices and infrastructure.

We have implemented commercially reasonable electronic, physical and procedural safeguards designed to help protect against the loss, unauthorized access or disclosure, alteration or destruction of the information under Our control. HyperVerge has a sophisticated security program intended to keep the information stored in our system protected from unauthorized access. We store your information in secure data centres. Furthermore, Our system is configured with data encryption, or scrambling technologies and firewalls constructed to the highest industry standards. We also use Secure Socket Layer (SSL) technology that protects the data you send over the internet. 

We recommend that You use the latest available versions of browsers in order to take advantage of updates in security technology. Although We strive to protect Your encrypted information, no data transmission over the Internet is completely secure. There is some risk associated with any data transmission, including the risk that Personal Data may be intercepted in transit. Therefore, We cannot guarantee its absolute security. However, We have put in place necessary procedures to deal with any suspected or possible breaches of Personal Data and will immediately notify You and any applicable regulatory authority of a breach where We are legally required to do so.

INTERNATIONAL DATA TRANSFERS 

By providing Us with Your Information, You agree that we may store, process and/or transfer the data as required for the Services. In certain instances, for the performance of the Services, Personal Data that Our Users submit, may be sent by Us/Partner Platform and stored on secure servers located in the India and may be transferred by us to Our group companies and third-parties and partners (such as our Subcontractors) present in different countries around the world where they operate. These third parties process your Personal Data in accordance with the laws that are applicable to them. The countries where Our third parties process Your information may not have similar data protection laws to India. Furthermore, the regulatory agencies and legal authorities practices and the methods through which they access the data in those countries is significantly different from the practice in India. When information is transferred by Us, We shall ensure that your privacy rights continue to be protected by taking all the required steps which are consistent with our obligations under law. 

 

DATA RETENTION BY HYPERVERGE 

We may retain Your Personal Data for the purposes stated in this Policy and for the Services. In certain cases, We may retain Your information for a longer duration to comply with applicable law, a potential/active legal claim, to enforce Our agreements, to comply with other legal obligations or any other reason as required by law. After the completion of processing Your Information for the Legitimate Interest as per this Policy, We shall either delete (within 14 days) or anonymize Your Personal Data from Our databases, unless otherwise required by applicable law. You further agree that We may retain any such documents or references evidencing Your consent (including DigiLocker IDs) and reports and are authorized to share the same with Partner Platform. Anonymization is the process of removing personally identifiable information from data sets, so that the people whom the data describe remain anonymous. We shall also securely store the information and isolate it from further processing until its erasure. Notwithstanding anything provided in this Policy, Partner Platform, shall have the right, at its own discretion, to utilize and store such Personal Data indefinitely in accordance with applicable law and internal controls followed by Partner Platform and which shall be in line with such Partner Platform’s privacy policy (which privacy policy shall govern the further processing/storage/usage and transfer terms with respect to the Personal Data (We urge you to examine and assess the said privacy policy). 

 

CHANGES OR MODIFICATIONS 

HyperVerge reserves the right to change this Policy at any time. We may modify this Policy to reflect changes in the way We collect, use, or disclose information, or to reflect changes in privacy laws, regulations, and/or industry standards.
